By accessing and browsing our website, you agree to be bound by these Terms of Use, which are applicable to your purchase of products via our website. Topsy Turvy NZ Limited, referred to as "we" or "our," operates this website to provide information about our products and enable online purchases. We have made every effort to provide accurate information on our website, but errors and omissions may occur. Our products are described with detailed information, including dimensions and any relevant notable comments about said item.

We reserve the right to make changes to the website content without notice.

PRICING

The prices for products listed on the site are in New Zealand dollars and include GST, but exclude delivery charges. We reserve the right to amend any errors in pricing or product description within 24 hours of being notified of it.

 

ORDERING

An order made via our website is an offer to purchase product/s. We will acknowledge receipt of your valid order by email and take payment when we accept it. Once confirmed, your order cannot be changed or canceled.

DELIVERY

We deliver via Post Haste to New Zealand and select international addresses. Ensure the delivery address and receiver’s name are accurate and complete, including any business name for shipping to a work address. We are not responsible for orders that go missing due to incorrect delivery information provided by you. Delivery to rural addresses may take longer in some areas. Delivery is considered complete when the goods arrive at the delivery point agreed upon.

You must notify us within 7 days of the dispatch date if you have not received an item.

DAMAGED/FAULTY ITEMS

We take care in packing orders with fragile products, but we rely on third-party couriers for delivery. If your order is damaged in transit, please contact us immediately with photographic evidence and full details of the condition/damage. Do not dispose of any items until advised by us, as we may need to return them to the courier for inspection. While we cannot control these situations, we strive to rectify them with the customer.

RISK

The risk of loss of or damage to the products passes to you upon delivery.

PRIVACY

We respect your privacy and take measures to protect your personal information as required by the Privacy Act 1993. We will not sell, publish, or give away your personal information to any person or organization unless required by law. We may use information obtained from website users for statistical purposes, but we will not identify the user.

CONSUMER GUARANTEES ACT

These terms and conditions do not limit or affect your rights as a consumer under the Consumer Guarantees Act 1993, to the extent that such limitation or other contracting out is prohibited by that Act.

FORCE MAJEURE
